A legacy case is an exceptional request by a member of the High Carbon Stock Approach (HCSA) seeking permission to clear High Carbon Stock (HCS) forests for development in an area that has over 80% forest cover.\u00a0 These forests are defined by the HCSA as \u2018High Forest Cover Landscapes\u2019 (HFCLs).<\/p>

Following deliberation by the HFCL Working Group in 2017, it was decided that deforestation in these landscapes is not compatible with a No Deforestation commitment.<\/p>

However, the HCSA will work with stakeholders to identify alternatives to the industrial plantations model within HFCLs, meeting community aspirations and allowing development as well as conserving HCS forests in the long-term.<\/p>

For a strictly limited number of existing \u2018legacy cases\u2019 of concessions in HFCLs that meet eligibility criteria and agree to enter into a due diligence process, this may include limited conversion subject to specific thresholds and procedures, via an agreed legacy case review process.<\/p>

Four legacy case requests were received by the HCSA before the application deadline of June 2019. \u00a0Only one case proceeded to a full, in-depth due diligence investigation.<\/p>

A specially convened Legacy Task Force made up of HCSA members representing each membership category was formed and was chaired by HCSA\u2019s High Forest Cover Landscapes Working Group.\u00a0<\/p>

During the due diligence phase that took place from May to Sept 2021, the Task Force engaged with the applicant reviewed the information provided and commissioned an independent consultant to conduct desk reviews and on-the-ground field verification. \u00a0The consultant examined the information provided by the applicant, other stakeholders and rightsholders.<\/p>

The Task Force found that HCSA the requirements to qualify for a legacy case request were not adequately met by the applicant. \u00a0Permission to clear High Carbon Stock forests was not granted by the HCSA. \u00a0<\/p>
