A legacy case is an exceptional request by a member of the High Carbon Stock Approach (HCSA) seeking permission to clear High Carbon Stock (HCS) forests for development in an area that has over 80% forest cover. These forests are defined by the HCSA as ‘High Forest Cover Landscapes’ (HFCLs).
Following deliberation by the HFCL Working Group in 2017, it was decided that deforestation in these landscapes is not compatible with a No Deforestation commitment.
However, the HCSA will work with stakeholders to identify alternatives to the industrial plantations model within HFCLs, meeting community aspirations and allowing development as well as conserving HCS forests in the long-term.
For a strictly limited number of existing ‘legacy cases’ of concessions in HFCLs that meet eligibility criteria and agree to enter into a due diligence process, this may include limited conversion subject to specific thresholds and procedures, via an agreed legacy case review process.

Conclusion of legacy case application, May 2022
Four legacy case requests were received by the HCSA before the application deadline of June 2019. Only one case proceeded to a full, in-depth due diligence investigation.
A specially convened Legacy Task Force made up of HCSA members representing each membership category was formed and was chaired by HCSA’s High Forest Cover Landscapes Working Group.
During the due diligence phase that took place from May to Sept 2021, the Task Force engaged with the applicant reviewed the information provided and commissioned an independent consultant to conduct desk reviews and on-the-ground field verification. The consultant examined the information provided by the applicant, other stakeholders and rightsholders.
The Task Force found that HCSA the requirements to qualify for a legacy case request were not adequately met by the applicant. Permission to clear High Carbon Stock forests was not granted by the HCSA.

Announcement: Call for Legacy Case Applications
June 2019
Applications for Legacy Cases may be submitted to the HCSA Secretariat during a sole submission period, after which a designated Legacy Task Force will review the case against predetermined eligibility criteria. Cases meeting these criteria will be subject to a due diligence procedure.
Deadline: 30 June 2019
Requirement: Companies to submit a legacy case review application, with all supporting documentation for eligibility determination to the HCSA Secretariat
Data limite: 31 August 2019
Requirement: The Task Force will review the applications and their supporting documentation for completeness on a rolling basis. This process may include feedback to the company about incomplete documentation, with an opportunity to re-submit documentation prior to the deadline.
